Well....

Sure it's a bit harsh maybe, but on the other hand It's sort of "stupid" to name your deli Rolex to begin with.

Might go well in less developed countries, but sort of asking for trouble.

Looking at his storefront I can understand why Rolex wants to shut him down, after all it's almost an exact copy of their storefront on 5th ave.

It's a terrible crime he has commited and people of course think he's related to Rolex specially if he serves Swiss cheese on his subs.

I'd like him go pro se, miss one or two hearing dates by calling the court clerk at the last minute, go on Letterman, head to a bench trial where the judge can compare his evidence: a Reuben on Rye with a side order of Chocolate Rose Gold Daytona.

I think it's reasonable only because the name Rolex was coined by Hans Wilsdorf specifically for his watches.

The name Rolex is associated worldwide with watches.

And it is a bit presumptuous of the deli owner to grab attention by using a proprietary name.

What I do think is ridiculous is when the Olympic Committee goes around forcing businesses to change their names, as if the Olympic Committee owns Mt. Olympus.

It is also ridiculous when Apple sues Samsung because Samsung's tablets are rectangular, have a flat face and rounded corners.

Where's the lawyers around here ? if the guy isn't using the logo, I always thought that there was no way to copyright a name or word in and of itself.

Names or words can be protected whether they have a logo associated to it or not.

The USPTO protects trademarks and brands within the classes they were filed for. For instance, if you file a brand name under the 'Clothing' class, then you are protected within that specific category only. To be protected under other classes you need to add those and get approval from the USPTO, otherwise, people could potentially use that name for other types of products outside the 'filed class(es)' without creating confusion among consumers and getting away with it.

IMHO in this case I will proceed. The man is selling Subs for God sake!!!
