You still can unless you cause injury to health of persons or damage to property. $1000 and jail? Come on?

I'd be somewhat curious as to the reason for this.

If someone coughs it's perhaps enough?

It just says your fire/smoke can't cause damage to someone's stuff, doesn't say you can't make fire/smoke. Something must have happened where it did cause damage.

Wow! I wonder if I can waive in to the Hawaii BAR? With laws drafted THAT poorly, you need lawyers just to protect yourself from City Hall. Yikes.

Yes it started when a friend of Hoser I mean Hooser said that a neighbors wood burning fireplace is causing his daughters asthma! So Hoser to the rescue to make sure we are all safe from wood fired fire places.

This bill has all the hallmarks of something that was originally written in a Big Chief tablet with a crayon. Apparently, your city council had recess indoors that day - either that or Pee-wee's Playhouse was a rerun.

When I was there about 18 months ago, in order to smoke a cigar, I had to be more than 1000 feet from an entrance to the resort. I was literally in the dark, on a cliff, overlooking the ocean at night. Beautiful island, crazy laws.
