What would you do? (Round 2)
I had a car transported to me. A recent purchase. Older car. Now quite classic. But getting there.
Anyway, it's a nice car. Mint. 100% stock. I hired a transport company as it was in South Hampton, NY. If you know anything about the Hamptons, traffic is a nightmare. It would have been an all day event. So I ended up receiving the car damaged. Two wheels were heavily damaged and the front bumper was scraped. They sent the wrong driver and the wrong transport tool. The driver was distraught. Obviously. But did not speak a word of English. His wife translated for him. I actually felt badly for him. He tried to give me $500. I took it and then gave him back $200 as I felt badly and I knew that meant he now lost the entire payment. I was not please upon getting it. Obviously. I called the company. They say they will cover the cost to get it fixed. I sent it to them yesterday. It was $1,900. It could have been worse if I replace the wheels. But I am okay just refinishing. I get a call back today. The driver is required to pay for it...by the company. He needs to work over the next few days to pay for it. He will send it to me once he saves up enough. What do you do? (again, I have already made up my decision and in fact implemented it).

Sounds like you're up $100 now, buy some lottery tickets with it
All kidding aside, that's another tough situation. Mistakes happen and not sure the driver should be the one responsible to covering the cost. The company should step up and pay for the damages. With the line of work they are in, I would think they have insurance to cover it.

Any legitimate transport company would have insurance to cover damages.

I'm not sure traffic in the Hamptons is an excuse or reason for damage. We've transported a high value car from east to west and did our homework as far as reliable transport (pun intended for those who know) to assure pristine delivery or coverage if not. |

Company should be paying. The fact they openly tell their customers the drivers are responsible for damage is classless.
I’d figure out how to make the driver square and not require payment from him. I would hire a different transport company on the next go around. It would have to be dire circumstances to use the stated company ever again. I’m cheap but a couple thousand won’t make or break me. That most likely isn’t the case for the driver. To be frank, he probably was sent out with the wrong equipment for the job by the company (you know, cost saving measures, do more with less). Which means the liability is on the company. I am in a business where we are always transporting heavy equipment on owned vehicles and trailers. I’d probably offer the guy a job as a driver and provide the proper equipment for the job and insurance that covers him in case an accident did happen. Sent from my Apple privacy invasion product |

I had my car transported to Florida and it arrived in pristine condition. If it was damaged, I would agree with above posters, transport company must be insured. Maybe they are pulling your chain to avoid a claim, hoping you feel bad for the driver. I would not take any money from the driver and ask the transport company for the contact information for their insurer. If they don’t give it to you, send them the bill.

Sounds more like a broker which is how many of these “transport companies” operate. Independent contractor agreement.
I’d be tempted to let him work if off by doing some future work for you but he’s already proven incompetent in some regards. Honestly I think you’re letting him off easy at 1900, Id have him pay his debt. He understood the terms of the job.

The driver must be taught a lesson and the carrier should be reported. Poors need to stop pulling the heartstrings of the rich when we give opportunities and they fail, and businesses that punish unqualified labor because they went cheap need to be held accountable.

Sounds like somebody must be insured to cover these things in the event of damage. What if the car fell off the carrier while in transit. Would be more than a few bucks.

If he’s an owner operator, he’s got his own insurance. If he’s an independent contractor, he has a contract with a broker/logistics company and that firm will carry his insurance.
It’s likely that the brokerage doesn’t want to file a claim and is insisting the driver pay for it. Either that or it’s an illegal operation. Regardless, you’re owed 1900 minimum and need to be made whole. I’d settle for nothing less and kindly emphasize the hit you took on the wheels to the driver. |

I told them to let it go.
Maybe I’m a softy. Maybe I’m a sucker. It’s okay. I’m taking in the bad place on a few things lately. But I keep thinking about this guy having to feed his family. Breaks my heart. Was it shady? Is something here wrong? Yes. I should have gone with the guy transporting the SF90. But it was double. In the end. I’m paying double higher price. Such is life. Hopefully karma will come back and be my friend.
