Malfunctions Void All Plays and Pays
OK. By now 99% of you have either seen, read or heard about this incident. Some woman won $43M on a slot machine at the Resorts World Casino in NY and the proprietors offered her $2.25 and a complimentary steak dinner in lieu of the pay-off citing a slot machine malfunction. The state Gaming Commission has also dismissed the win as the machine displays a sign stating “Malfunctions void all pays and plays.”
This case will obviously be going to court. If you won $43M on a slot machine only to be told by the gaming resort that the machine was malfunctioning would you settle for a free steak dinner and $2.25 in cash? |

This was reported back in November. No surprise the OP couldn't provide better context on the actual incident. Key takeaway is that the woman was playing a penny slot machine with a posted max payout of $6,500.00. Obviously, a machine that is only supposed to pay out up to $6,500 shouldn't be displaying a $43M+ payout.

If it is the buffet at Caesars Palace, maybe.
I am sure there is case law on this exact thing and I am sure that the casino probably has a lot more money to fight it than the patron does. I guess it really depends what they are deeming a "malfunction". If the malfunction was it accidentally spit out something that paid her $43m I am sure they have insurance if some sort that will help pay this claim. Sent from my iPhone using Tapatalk |

Is it a bit like a Bank that shows a deposit of $43M to your account and then says "Opps, made a mistake - machine error".
I'd take the $2.5 and the steak dinner and be well pleased.

If this happened to me, I would strategize this way...
Tell them you are going to sue. Yes, it will cost you a lot of money but it will cost the casino a lot as well; attorneys are not cheap especially those that work for a wealthy casino. Negotiate that the costs to the casino could well exceed one million dollars for legal fees. Tell them you will accept one million dollars and won't sue. You never know, they might go for it. No, it's not 40+ million but how many can say they won ONE million from a casino? And if they say "no" maybe they agree to half a million? Still a nice chunk of change. |

I agree with Paul except I would not say anything. I'd leave, hire an attorney, then send them a letter that I intend to sue and see if they make an offer. I would normally not be inclined to sue anyone but a casino I have no remorse lol

The casino industry is heavily regulated. What do the regulations require? If the casino is compliant, and the machine is marked, there is no case. Not even an ambulance chaser would tackle this if the casino is following the regs.

I just read this from a software engineer that used to write code for those types of machines. Basically when someone wins, the machines are locked down and inspected for faults and fraud. Why? The casinos don't pay off the winner, the company that made the machine does, hence why it is inspected when a big win happens. So to answer the question, she isn't getting jack. Should have taken the steak dinner.

They said the machine was malfunctioning, did allow the machine to accept any money though. So every time there is a jackpot win, all Casinos have to say is, the machine was malfunctioning at the time so they don't have to pay any money out. A strange case but she is bound to lose because she is taking on big business, not fair but part of life.

Off-topic but while doggy bags are OK for one's unfinished dinner leftovers, many (or some) of us have probably seen people at various 'all you can eat' buffets stuffing their purses, pockets and whatnot with assorted food items and IMHO, this unsavory practice leaves something to be desired.
I once recall a woman opening up her purse and handing out some XL zip-lock plastic bags to her accompanying children at one of these establishments and they then proceeded to race through the buffet line stuffing the bags with meatballs, shrimp and whatever appealed to them. Eventually they were reported to the restaurant manger who confiscated the bags and issued a permanent '86'. In retrospect and had I been the manager, I would have let them keep the bags (since the food couldn't be re-served) while maintaining the 'don't come around here no more' edict. |
