Icon4 Twice broken down

My fairly new hulk submariner stopped working completely after almost two years and was sent to rolex. Came back working fine. I figured oh well, must have had incredibly bad luck and now that's through. I'd love to have known what was wrong but apparently rolex doesn't disclose that? Now a little more than a year later, my sub is running +14. My wife's new DJ runs +0. Took it to my AD who is now fixing it in house, which is prob fine as they're a decent size boutique in a big city. My question, how unlucky is this? Seems incredibly unlikely. Can it be a lemon? I was just about to invest in a blue YM and a new 39 OP. I'm more than peeved and am flat out angry. Even asked if they'd just give me a new one, Is that way too much to ask? Having to be opened up twice well before its first service? Do I have to have a third strike on this watch?
Really appreciate some thoughts, thanks.

Stopped working and being inaccurate is two different thing ,if watch had a certain shock or if you work in magnetized enviroment ,etc all having ill effect on accuracy the good news is microstella is one of the best-if not the best- regulation tool ever built,no worry

It happened to me with my Sea-Dweller. Two weeks after a service it just stopped. I sent it back under warranty and waited three months for it to be repaired. A month after I got it back it stopped again and went back once more. It can and does happen.

A Rolex is just a machine and just like any other machine they can go wrong. As for simple regulation again all movements some time in there life will need regulation. Now the COSC test is only for the time of testing, its not a guarantee it will perform like that for life. But with normal routine service Rolex with regulation will try to keep it to spec.

I wonder if there's a point where Rolex, simply replaces it

I'm not clear on the time frame here. Am I correct in understanding that the first failure occurred after nearly two years of ownership and while still under the Rolex two (2) year warranty and the timing issue occurred almost one year after that? If so, I would be quite surprised if Rolex or an AD would agree to replace a watch under these circumstances but perhaps as a courtesy, Rolex might agree to provide a free regulation. One failure and one timing issue during approximately 2.5 to 2.75 years of ownership may be frustrating, aggravating and disappointing but not so egregious in my view as to justify replacement. Let us know how this resolves.

Don't know why it stopped the first time but a watch suddenly running 14 seconds a day can happen to any watch and hardly fits the "broken down" definition.

Over 3 years of ownership and two problems (fixed) hardly qualifies as a lemon by any lemon law definition.

I'm with those who say that if you feel your watch doesn't meet your expectations, trade it in on what you want..

Thank you all for your advice. It seems I should probably just hope for relatively smooth sailing from here on. Although a relatively new rolex suddenly not working, and then being quite fast and way way out of spec is certainly not living up to almost anyone's expectations. Perhaps my AD will surprise and offer to replace it, although I highly doubt it.
I'll keep everyone posted on how this pans out. Thanks again.

Not a chance they will replace it. Nor should they.

It's a mechanical device and it happens. Not a big deal really.

Call Rik Dietel at Time Care Inc. and tell him what your watch is doing. He can regulate it to spot on accuracy. He is an indy CW21 Watchmaker and does incredible work. He is located in Florida so you must be willing to mail your watch out but it will come back running better than new.

Thank you all again for your thoughts on this. Picked up my hulk sub today and the mystery deepens. Watchmaker, rolex certified at a rolex boutique, opened it up and could apparently find absolutely no reason for it to be running +12 or +14, and apparently only +5 face down. No screws loose whatsoever is what he said, no loose microstella. He said he has got it down to about +2 or so. When I brought it in they did say that it was slightly magnetized, could that've been it? More importantly, is it awfully odd to not be able to locate the problem at all?
Hopefully this will be the last trouble with my beloved first rolex, I add a blue YM and/or the new blue 39 OP later in the year and am very excited.
Btw, has anyone seen that new blue OP in person and can tell me how conspicuous those green dots are? Not sure why Rolex decided that dial needed neon green dots. Thanks.

Well today IMHO magnetised is a cope out in many cases for nothing more than simple regulation. Now Rolex uses the parachrom hairspring and they state it cannot be magnetised. And in general although other parts in the watch can get magnetised its the hairspring that effects the timing the most. Many things can effect a slight change in accuracy like change of temperature, different wearing habits, state or power reserve in mainspring even the effect of gravity. When the bare uncased movements are tested at the COSC in the first 10 days of testing the movement could vary by 10 seconds either way over any single 24 hour period and still pass the test.
