Hold on. the buyer used a stolen credit card, that's a matter between paypal and the buyer. It should not be your problem. Paypal accepted his credit card and it should be paypal (or their insurer) copping the loss. Since when you have to cover paypal's loss?

Matt - sorry to hear of your loss. I had a somewhat similar issue with Pay Pal about 4 years ago, however, I didn't sell anything... someone got hold my card details and gained access into my account to make cash transactions. They tried to sting me with that contract crap about card details, but I wasn't buying it. Turns out the scammer got hold of a replacement card being sent in the mail - cleared me out nearly £3k.
A swift claims letter to Pay Pal is in order I think. Gotta really talk it up - express how negligent they have been, un-due stress on your pregnant partner, yada yada yada - within a week I had all the money credit back to me. I hope it all works out. |

Wow! This is absolutely terrible. I'm really sorry to hear that this is happening to you Matt. I hope you will get your watch/money back asap. It is strange that they are making the criminal's actions your problem.

Hi Matt, I am sorry this thing happened to you! A few years ago, I was defrauded on paypal by a buyer who bought some the stuff I was selling on Ebay! After a couple of weeks, I noticed that the funds paid by the person was taken out of my account! Found out later on that it's a stolen card as well! I called my bank and they told me to fill up some forms and the next day, money was back to my account! Paypal should take responsiblity for that matter since they're the one who accepted the credit card transaction!

Update is that I am waiting on the police report, should have a copy in my hands by 05/10. I faxed the terms and conditions to my lawyer yesterday, might take him a day or two. As soon as I have the report, its off to Rolex it goes. Shot in the dark, I know. I will update when I hear from my lawyer.
