Nice website/tools! Oddly enough, he sent me a direct email a few minutes ago. (not via ebay.) here it is:
Hi, Sorry, Please let me know what do you mean by "illegal to ship to USA? " Every shipment send to all over the world by Fedex have to declare the value of the item. For all my ebay buyer, I declare lower than the actual winning amount for the good sake of buyer to save some tax. I can amend the declare amout to Fedex if you want me to declare the actual amount of your winning bid. Please let me know. mtwatch You are definitely helping me out so much! I would have been 100% lost if it wasn't for this forum and your help. I also noted, bad communication comments left from several buyers on his feedback.(after using the tool you linked) Yes i talked to the supervisor and made him aware of the situation, he was actually the one who suggested contacting Paypal, due to the funds already being taken out i'm guessing? |

It can be argued that it is the seller's responsibility to deliver the watch to you/your address, as you have paid him to do so, and so if the watch is confiscated, it is his loss.

How kind of the seller! As directed Don't respond to the seller further period. Meanwhile, yes, that is why I'd suggested covering all bases eBay/PP and CC co. It is a matter of covering all bases. Yes, your cc account is linked to Paypal and the transaction was processed via Paypal. It's SOP. Just let them follow-up and try to be patient, and make sure you follow-up accordingly. You should be receiving a written communication from Paypal via email at some point. Did you per chance look up the Fedex Int'l shipment details - (just curious). Might I ask what CC carrier is involved? Do, Photograph everything and ask PP what they want you to do if/when the package arrives? Depending on what all advise PP, CC ..(Perhaps you'll want Fedex to witness as you will be required to sign for it).
Me, I only talk to supervisors when there is an issue and get names ;) Yes, Adam absolutely..( Adam is a well respected member of TRF) and btw Don't ever let a seller tell you it's your headache if an item doesn't get delivered. It is legally always the responsibility of the seller! |

I am pretty sure that your seller is not aware of the fact that Rolex products can not be shipped to the US but get confiscated.

update! seller responded via eBay finally! seems to be good news, aside from I guess customs could still intercept it?
Hi, Let me explain the whole situation. You made payment on Sunday and I sned the parcel on Monday to Fedex. Because of time zone different, I recevied your message after I send the parcel to Fedex. I try to retrive back the pacel from Fedex but unfotunately it is transit at Japan and Fedex staff can only do inform Fedex USA to retrive back. But due to time zone differnt, they can't guarantee whether it can stop the parcel or not. So the parcel will be delivered to you if they can't to do so. But don't worry, if the parcel was delivered, please reject it and it will be send back to Singapore. The dispute was already open at Paypal and Paypal freeze the transaction amount and it will be release to you when the parcel was return back to me. I will update again the information from Fedex. sundaynitesorrow, I would highly suggest ASAP that you in turn communicate with a supervisor at Paypal and apprise them of the sellers response/email. I caution you to proceed solely as directed by them (Paypal) versus the seller. I suggest you proceed solely as directed by PP in regard to the matter henceforth via case number. As for the future disposition on the timepiece, should it arrive, they PP should direct you accordingly in the appropriate course of action. Often times PP will act in conjunction with a CC company.
Evidently, you indeed now have the sellers attention, as they have allegedly frozen his account. As mentioned previously Paypal in fact has the ability to do just that and under the circumstances it constitutes SOP. Paypal, directed that you Not communicate with seller further and the matter is being handled by them. The legal technicalities involved are such that I recommend you proceed as directed upon PP's further advisement. You might ask that PP kindly send you a follow-up in hard copy for your files in reference to this matters case number. Dot all "T's" and Cross all "I's" ;) Right now all looks quite promising!! I did all the above you suggested. I looked up the track and the current status is: clearance delay - import. is that bad news for me? PayPal explained that I will get my refund when the package is rejected by me and reaches the seller. (confirming by the tracking number) hmm?

Hi, Not necessarily. "Clearance delay" may be attributed to a number of reasons. However, If you do not receive the "package", your recourse is protections afforded via CC, as well as, via PP and eBay. (Seller on the OH will have none versus yourself).
Meanwhile, Did you receive any hard copy from PP? Further updates should be available and as well you can call Fedex for disposition on clearance/release of the shipment. Please keep us posted! |

Update: As of this moment the seller reached FedEx and had the package canceled/reversed back to him. The only problem I am having with that, is that FedEx assigned it a new tracking number. (which threw Paypal off and set delays my refund, due to the fact the refund is issued after confirmation that the seller received the item back.) I called Paypal about the new tracking number situation and it seems I will get my refund in 10 days. Not sure why, but from what Paypal has told me, every time there is an update on the claim/cause, the refund gets reset to 10 days after the most recent update. That makes it somewhat frustrating because my goal has been to keep them updated as much as possible with the situation, which in turn, keeps pushing my refund back. Overall, other than having to be patient, this is good news! I have to once again, thank everyone for the help!
(I have received and saved all documentation from every call/email/message/screen shot saved in a folder on my computer in case I possibly need in the future.) |

Now that's Great news..Meanwhile, sounds a bit ridiculous to say the least regarding Paypal but glad all is working out in your favor. High Five!
Meanwhile..you can shop around here at home stateside for your future first Rolex! If you check out the Rolex classified section..you can post and ask the community their thoughts and get feedback on sellers, etc, etc. And otherwise, please keep coming back and if something catches your eye just post images and details in advance and shout out ;) Hopefully, we've shown you that the community here genuinely cares and will honestly bend over backwards to help you make a right choice.. as headache free as possible. Honestly, I can hardly wait to see the photos of your future Rolex! |
