Opinion Needed on Potential Dispute
Bought a watch off the Bay from a reputable seller, so no worries there. Thing is the watch was listed as new, but I noticed the power reserve was something in the vicinity of 31 hours when it is listed by the manufacturer as 42. I contacted the seller and he told me the item was new old stock and so it may require being sent back for servicing. He was honorable about this, and offered to do this at his own expense all the way down to return shipping. At first I was satisfied but then got to thinking that I didn't want to spend more than $2500 on a watch that required service the moment I took delivery because it was NOS and not new and thus had been sitting for a long time. In no way do I think the seller was being deceptive; I believe it's just one of those situations that arise from time-to-time. I contacted him via e-mail just a few minutes ago and asked that I simply return the watch and be refunded my purchase price. I would like to solicit other opinions so as to make sure *I* am dealing fairly and that what I am asking is reasonable (or not reasonable). I have had the watch four days, have worn it a couple of times, and it is indistinguishable from the condition in which I received it. I have everything it shipped with.

This is on odd one, has the style of watch changed, I guess all watches or all items sit for a time being so would those items not be considered new. I understand your side of the argument and you should not have to deal with any service issues as it is suppose to be a new watch. I don't think it is unreasonable to ask for a refund. I also see from your post how you see both sides as well.

It's a Chopard and I'm not that familiar with their catalog of watches, though a perusal through their site shows it is NOT being manufactured in 2012. I just don't want to have to deal with a service on a brand-new piece, then who knows what going forward (where there is no warranty). The seller is not trying to put one over on me at all, but if the piece had been listed as NOS it would have impacted my offer price. I saw a '96 SS white dial Daytona NOS and ABSOLUTELY factored the age and NOS status into my offer. These are different circumstances, of course, and I'm assuming the seller isn't going to want to take the piece back. He maybe perfectly willing to, in which case I'm wasting electrons, but I want to be prepared, and also to be fair to me and to him. Thank you for your response.

The way the seller is handling it and the fact that he is paying for the service in most cases is the way most retail outlets would handle the situation.
After the service most manufactures will warranty the watch for another 1 or 2 years. Not sure how Chopard handles this. Who is he actually having service the watch? The manufacture or an inndependant watch maker? Did he indicate if you get the paperwork and if they would warranty their service work? If it's the manufacture and their service center and they warranty the work for 1 or 2 years then no issues.

Your seller seems reasonable by the way. So I might want to direct your questions and concerns directly to him or her and see what they have to say.
Phone call typically works best in these cases in my opinion.

My honest opinon is .. If you like the watch, and he is willing to repair it at no cost you you .. Have him fix it, and you enjoy it for many long and wonderful years .. Good luck

Please do not be offended but I think you are being picky. When you buy a new watch from a dealer, who knows how long it has been sitting in his display case. Or how may try ons it has logged. Or how long it sat on the manufacture's shelf. You seller is being very responsible by offering to have it serviced and even paying for shipping. This is just one man's opinion. Others may differ

When I was looking for a Submariner I noticed that a lot of them had been sitting for 2, 3 maybe even 4 years before they are sold. The Sub I just bought has an early "Z" serial number, indicating 2006 manufacture. According to the warranty paperwork, it was first sold to the guy I bought it from on 12-29-09 . A good solid 3 1/2 years after it was made. Based on this I wouldn't be surprised to see some less popular models sit even longer before their first sale.
