Thoughts on my purchase?

Congrats! You are in the USA and this watch is located in Singapore? What are the duties? Well, It's my rule to always purchase stateside with regard to online purchases. Meanwhile, DJ is a timeless Rolex classic as for all else, I'll leave it to our esteemed experts :)

You will have problems with USA import laws, search threads it's a sticky or in reference section. Price is average price without a band. The watch itself is a good starting Rolex.

Isn't it a 1601?
It has a 1570 movement, case is stamped 1601 and the serial indicates early-mid 70s.

The caseback is wrong, it is for a 16000-series Rolex apparently. They have a 3035(?) quickset movement and sapphire crystal.

Oh, as others have noted, it is not legal to import a Rolex into the USA except when wearing it. There is a risk that customs will confiscate the watch if you have it sent to you by mail.

Congrats on a nice piece. As others have said, importing a Rolex into the US is always worrisome due to customs. If they open the box and see it they usually confiscate it. Not sure how sellers abroad handle this but I am sure the risk is all on the buyer from their perspective. For me it would not be worth the sleepless nights!

That's definitely a 1601, not 16000. The dial is pie pan and the movement is nonquick (1570). Looks like that case back came off another watch. Getting a Rolex out of Singapore is almost impossible if they catch it. I would request a refund and terminate the transaction.

What some of the communities members are referring/eluding to and again I always defer to our experts ..But in explaining it to the best of my ability as I have been led to understand it (and frankly, am not aware of any subsequent amendment..repeals etc). Hope this doesn't confuse ..and I am not wanting to alarm you but share information that may be helpful .. .

I believe it technically falls under provisions indicated essentially as follows..

Import of Goods Bearing Genuine Trademarks or Trade Names Restricted. (Subject to) Seizure and forfeiture. Any such merchandise imported into the United States in violation of the provisions of this section shall be subject to seizure and forfeiture for violation of the customs laws.

Essentially..
Buyer or a designated agent may collect the property in the country of sale. The law does allow any individual to hand-carry one Rolex through US customs without seeking the trademark holders permission. However, lawful compliance requires filing of a Customs Declaration and payment of duties.

As for online purchases such as the one described herein, US Customs can lawfully seize any Rolex watch that's being imported into the USA without consent from Rolex. Rolex SA has assigned all Trademark rights to Rolex USA for North America.

Again as I understand it.. The importation via mail constitutes a violation of intellectual property rights unless it were to arrive in parts which is a separate classification of Harmonized codes which as well require declaration, duties, tariffs etc. Not to mention reassembly stateside.

Bottom line Buyer Beware.. .
Perhaps you've heard the expression "Caveat emptor" which is translated from Latin as "Let the buyer beware".


Based upon what the experts have assessed on this particular timepiece (Rolex). You certainly have very legitimate reasons for cancelling the transaction and requesting a full refund. It appears to constitute what is called a "Franken" watch. A Rolex assembled at the very least from unrelated Rolex timepiece parts which lawfully constitutes a "counterfeit". If the seller isn't cooperative your credit card company can as well take care of the matter along with Paypal..eBay.

Let us know what you decide and please know that everyone here welcomes new members. The experts will gladly jump in and assist in thoroughly examining any Rolex that you are considering. Here is the deal. I asked the seller to refund my money, once yesterday morning, and a follow up that night. The seller never replied and there is a tracking number now tagged to my purchase. I called eBay about the situation and they are attempting to contact the seller. The watch is being shipped via FedEx. According to my research, the only person who can have the person cancel the shipment is the seller. So that is where I am at atm.

Hi, I gather you requested to speak with a supervisor at eBay? In any event I expect you will follow-up and through ;) In the event your purchase is via a Paypal account linked to a credit card..Do notify your CC company and follow-up advising them accordingly. Fedex system logs all notifications et al.

Keep all your communication attempts with seller, ebay etc, etc.
I suggest you discard Nothing. You notified seller to cancel and they allegedly chose to disregard despite Singapore time versus USA. Just save everything. It will get sorted and no doubt in your favor, albeit, it's a process. Just cross all your "T's" and Dot all your "i's" as we say;)

I've saved all the messages via eBay. a total of 3. the next morning after purchase and that same night. I also sent one today. when I called eBay at first they told me there was nothing they can do because it was shipped. Then I was told because I attempted to contact the seller before hand they would attempt to contact the seller themselves. I was told to call them back 24 hours later if he did not respond. so far no response. A few questions if anyone knows the answer: am I out the money 100% if customers takes it? even if I attempted to contact buyer so many times ect? someone also suggested it was a rolex compiled of different rolex parts, would that mean it's not as described? thank you everyone for your help. I had/have no idea about any of this , just wanted my first rolex :/ for sure if this works out for me I'll be asking for suggestions on a safer better purchase for my first rolex.

The seller subsequently chose to disregard your request to cancel said transaction.. You and eB etc any CC co.. should be able to establish if the tracking number was provided prior to receipt by Fedex via Fedex (without much effort and determine date and time against your notification to seller).

Regardless and in any event, provided you have paid via Paypal and that your account is further linked to a Credit Card, versus direct debit from your bank. A Credit card company can act and reverse the charges and SOP (standard operating procedure) place the matter under investigation and essentially freeze the transaction. Paypal can in turn freeze the sellers account as well ;) Buyer protection SNAD (Significantly Not As Described)!!

The experts here whom have impeccable credentials have upon close inspection clearly deemed the piece a "Counterfeit" (which lawfully constitutes fraud on the part of the seller). The point is that in recognition of the fact it is "Counterfeit" eBay and Paypal as well as any CC company will/should intervene on your behalf SOP and you have lawful protections afforded you which should/will be exercised. It's a process.
Ultimately, You should not be out any money, all should be recoverable..essentially - Less time and aggravation!

Please keep us posted. And I suggest you do go ahead and provided the scenario involves a CC notify your credit card company of your cancellation and the details asap.
(Keep Saving your emails and make notes) ;)

If you ultimately should end up in receipt of the timepiece, all protections still apply in full force and effect.
Despite what anyone tells you, I suggest you Do Not dispose of any packaging it arrives in, nor the timepiece itself. ( Albeit, you will be instructed accordingly on how to proceed but lets err on the side of caution - As in "CYA" ;) You want your funds recaptured and all resolved without technicality or loophole.

If it were myself, I would advise them of exactly what has transpired and that you attempted in good faith to immediately act and cancel said transaction. The seller despite repeated attempts has disregarded your communications and allegedly subsequently shipped via Fedex. Experts have examined the images and deemed it to clearly constitute a counterfeit example of a Rolex timepiece. Advise them you are genuinely alarmed by what has transpired.

so sorry to hear....I hope it all works out for you in the end..

Just another lesson for others to learn....buy the seller and pay the extra few bucks for the peace of mind and quality....when spending thousands on a watch, why take a chance to save a few hundred bucks?

Update: I called the credit card company and the money was already withdrawn. They suggested I get in touch with Paypal. After calling Paypal and explaining the situation, they filed a dispute for me and also confirmed the money was already taken out of the sellers account. Paypal told me to call back in 11 days and they will investigate ect. to get my money back. They also mentioned i should not attempt to contact the seller anymore. In addition, they told me there is no need to contact ebay about the situation anymore. Suggestions other than waiting?

Again, sorry that this has been a headache. Really, do look forward to hearing when the matter gets resolved. And welcome to the community. You will get this sorted and behind you and get the Rolex that you envisioned. Hang in there!

Paypal gave you appropriate advice, and as well, in regard to having no further contact with this seller. You have done all that you need to at this time. Paypal will assign a case number. Did you speak with a supervisor at your CC co? The fact seller withdrew the funds is not surprising! Once the charge is reflected on your CC statement you will want to call and formally dispute the charge, as seller misrepresented the piece (and as discussed you'd attempted to stop the transaction and shipment of the item).

Meanwhile, Try not to worry! PP will follow through accordingly. When/if it arrives do file the SNAD via eBays system. Please Keep us posted with future updates!!
I took a couple of screen grabs/capture images of your auction listing inclusive of shipping terms. Always a Good idea while the listing is still up including photos, et al.

Meanwhile, here is a tip for future eBay reference.. Check out your seller on www.toolhaus.org as I recall it's a German site .. Personally, I've used it for years!
(I actually just did look at your seller's rep - Evidently, a real Gem). Also, always tick off false positives on FB they may have received. You'll see it there under Toolhaus.org logo upper left.

Received BY and also check off the box for False positives? (What's this?)
