Legislation.

Hello fellow watch aficionados,

I’m on a small trip in CH. Today I came across a Rolex in Switzerland with a displayed price and no indication that it was for display only.

Intrigued, I entered the store and was allowed to try it on, yet was ultimately not permitted to purchase it. Given this experience, I’m curious if Swiss law mandates sellers to honor displayed prices on products, similar to the regulation in Brazil.

Does anyone have insights on this matter within the Swiss context?

Appreciate your thoughts!

I’m guessing they can sell them to whoever they want. Obviously a history of buying things that you don’t really need to get you the watch you’ve waited years for helps

Off the street purchases in new Rolex… forget it, chances are one in a million. They will offered it to you if they want before you ask can i purchase it.

The AD owns the watch and up to him to whom he sells.
In Switzerland only to locals is my experience since they always referred me to my home country AD’s.

I can tell you, that the AD's here in Switzerland are not obliged to sell to you at all.

In the last ~6 months, most ADs now have the price displayed by the watch. Still 'exhibition only' though.

The seller can sell it to whoever they want, or not. If you were selling something privately you could decide who you sell it to. My AD keeps it simple; if a watch is displayed with a price you can buy it. This is not a legal requirement.

When we were in Switzerland, I dropped in at Bucherer in Lucerne.

The only watches for sale were CPO. I’m not sure they would’ve sold them to me though.

A fair point. I think the difference (ethically, if not legally), between private individuals and ADs is that an international brand with shop-fronts and passing trade should be obliged to sell goods that are displayed to the passing trade. Your AD is being ethical in my view, and I think that should apply to all ADs.

In the country where I live, displaying a price in a shop window already constitutes an offer, binding the parties if I enter the shop and express an interest in complying with the advertised price. However, there is also a provision here that allows the offeror not to honor the offer if the price is clearly a mistake
