Hold on. the buyer used a stolen credit card, that's a matter between paypal and the buyer. It should not be your problem. Paypal accepted his credit card and it should be paypal (or their insurer) copping the loss. Since when you have to cover paypal's loss?

Matt, I would go to your AD or call them up with your serial number so they can report it to Rolex as stolen...

Nope, at least what they told me that all you need to use a stolen credit card to buy things is the number, three digit code on the back, name and billing address. I'm SOL, completely F'ed. I believe somewhere in the Terms and Cond. that the seller is fully responsible for credit card chargbacks. The kicker is I was selling the watch to pay for baby stuff... ya know crib dresser ect cause my wife is due in August. Now I have to pay Paypal within 30 days or it goes to their collection department.

I called them yesterday and asked to speak with the Agent that was working on the dispute, the guy told me that Im not aloud to speak with the agent and that everything he found was turned over to the FBI. I asked to speak to the fraud dept, and again, they dont take calls.

Matt - sorry to hear of your loss. I had a somewhat similar issue with Pay Pal about 4 years ago, however, I didn't sell anything... someone got hold my card details and gained access into my account to make cash transactions. They tried to sting me with that contract crap about card details, but I wasn't buying it. Turns out the scammer got hold of a replacement card being sent in the mail - cleared me out nearly £3k.

A swift claims letter to Pay Pal is in order I think. Gotta really talk it up - express how negligent they have been, un-due stress on your pregnant partner, yada yada yada - within a week I had all the money credit back to me.

I hope it all works out.

I am having my lawyer write a letter to them, thats gonna do no good tho

Wow! This is absolutely terrible. I'm really sorry to hear that this is happening to you Matt. I hope you will get your watch/money back asap. It is strange that they are making the criminal's actions your problem.

Hi Matt, I am sorry this thing happened to you! A few years ago, I was defrauded on paypal by a buyer who bought some the stuff I was selling on Ebay! After a couple of weeks, I noticed that the funds paid by the person was taken out of my account! Found out later on that it's a stolen card as well! I called my bank and they told me to fill up some forms and the next day, money was back to my account! Paypal should take responsiblity for that matter since they're the one who accepted the credit card transaction!

Update is that I am waiting on the police report, should have a copy in my hands by 05/10. I faxed the terms and conditions to my lawyer yesterday, might take him a day or two. As soon as I have the report, its off to Rolex it goes. Shot in the dark, I know. I will update when I hear from my lawyer.

What i have figured happened is that it wasnt just a stolen card... its was a stolen paypal account. For lack of a better term, the owner of the paypal account had it hijacked, and his credit card was used to purchase my watch. He noticed on his card statement at the end of the month, so he contacted paypal/credit card company and had the funds reversed back to him. My lawyer believes that since it was a valid paypal account, that its their loss, not mine. All I can do is remain positive.
