Sorry to hear about your collision...

Unfortunately this type of accident is one of the hardest to prove fault, especially when each driver claims he/she had the right of way.

If both drivers approaching each other have a green light, then the party who intends to turn in front of the other has to yield. Put another way, the only way you can not be at fault when turning in front of someone else is if you (as you did) have the designated green turn arrow.

People are often surprised to learn that if they have a green light and another driver in fact runs a red light, the driver who turned has the 'greater duty' to yield, except in the case of a green turn arrow.

If you have a copy of the Arizona Traffic Accident report form, see who is listed in the first section. This is referred to as Veh 1 and is usually the more 'at fault' party. When it comes down to a 'he said-she said' situation, things like point of impact (did the other driver hit the front/middle/rear of yours) etc. can assign fault proportionally, which is known as comparative negligence.

It could be that the insurance companies discuss between themselves and arrive at a % of fault for each driver. Your respective loss would then have to be covered by your carrier.

yes shopping for a car is hard!! So many options out there, so many styles, safety ratings, insurance ratings, reliability ratings all play a part in choosing a vehicle.....

I just went through that headache.

Well we did have 4 people (adults) total in my car. My husband was driving. He works as a police officer....
The girl that hit us had a 12 year old in her car.
And at the scene there was a witness apparently (but they haven't been able to contact him) that saw that we had green.
So I think we're good on that!

We do, and we're vehicle 2. So we're good on that as well!

Sounds like you will have no worries with the witnesses in your car alone .
The 12 y.o. will not give evidence or its weight will be insignificant.
An independent witness is always good, but if there were 4 of you in the car and say at least 2 of the 4 can say you had green, that is going to be pretty compelling evidence.
Hopefully it will not come to that. At the end of the day the main thing is you get compensated either by your insurer or the other driver (hopefully they have insurance or financial resources).
