It's whole different conversation, but, it is: mechanical, has a sapphire crystal, 316L (which Omega uses, I believe). It just makes me wonder what the mark-up on Rolex is.
Not that it matters, since Rolex is the best value out there, I think, compared to other watch makers |

It's neither claiming nor pretending to be a Rolex.

Yeah, I don't get it. If they would have simply changed/omitted the "Oyster Perpetual DateJust" on the dial, they'd be OK.
Countless other manufactures blatantly rip off Rolex designs, but not their trademarks, and do just fine (Invicta comes to mind). If you are going to go to the trouble of branding with your own name/logos, it doesn't make much sense to "throw in" a couple Rolex trademarks as well. |

I do not think they are registered trade marks - just words.
I doubt Amazon would break the law, and they offer many "homage" pieces. In no way is that watch claiming to be Rolex, nor does it use the Marque Depose of Rolex. that is just my opinion, it is not legally standing a

The use by this new brand constitutes trademark infringement. Although I personally think it is a photo of an actual Rolex on which they photoshopped their logo and new phrases while leaving some of the text from the original Rolex in place. The term "Oyster Perpetual" is also a registered trademark in the United States. It was initially registered in 1942 and then re-registered in 1978. Both registrations are still "live." The registration number for 1942 is: 0394881. The registration number for 1978 is: 1105602. The owner of the trademarks is Montres Rolex, S.A. (society anonymous - which means "corporation" en francais) of Switzerland. Have tried to steer clear of the forum for the day and give myself a self-imposed time-out, but I felt compelled to provide accurate information regarding this matter. |

Technically I think Rolex do own the trademark to these words as they do submariner, crown clasp, oyster lock etc.

Well although, we know Rolex take no action against direct Rolex counterfeits i.e. ones that actually mention Rolex.
I am sure they would take action against the likes of Amazon to stop them selling "trademarked" items. You can find many "homage" pieces on Amazon and no manufacturer has stopped it. I have no legal knowledge in these areas, so will bow out now Thanks adam

You can read about some controlled buys that turned into major cases by googling Rolex v. Meece and Rolex v. Melrose - Those are just two of a large number of cases GAF has conducted. They are consistently policing the internet for people or companies who are infringing on their trademarks. I had a focus of corporate law in college.. I have a pretty fair amount of knowledge regarding intellectual property rights; the differences between copyright and trademark law; trade dress; and patent law. Feel free to pose any IP rights questions to me, and I'm sure I can provide an accurate answer - based in U.S. law of course. |
