Doesn't the loser have to reimburse you for filing fees? Or was that not the case because of the dismissal? I once filed a small claims court case for about $30. When I went to file it, the clerk said that the filing fee was $30. I said that I thought that if I won my case, then the other party had to reimburse me. She said that was so. The filing fee amount was of no concern to me, because I expected to win. The cost of hiring a process server was also of no concern to me. I prevailed in court and the other person wound up paying well over $100.

I do believe that loser would be required to pay my filing fees had we actually gone to court. The Dr.'s Group paid me my $85.02 on the grounds that they now have been overpaid since my big name insurance company finally paid the full amount of their invoice 5 months after it was received.

I was always very polite to my insurance company, but I did let them know what was going on with my suit. They may have had second thoughts about their initial payment, I don't know for sure.

Anyway, I got my $85.02 back, learned a lot, and made a HUGE POINT about the matter!
