What would you do.....
I got up around 5:30am GMT this morning to watch the Grand Prix, and with a few minutes before the start of the race I thought I'd have a look thru some of my saved searches on eBay. It was a search for Rolex's in the UK.
First item was a SS Daytona. The images looked okay, came with the full set of box and papers etc. Checked the description and all looked ok. Now, to be honest I'm not actually in the market for a Daytona, but I like to look anyway, I then noticed a major descrepency that sets all the alarm bells ringing.....the item was not an auction item but a buy it now......for only £100. First thought as usual, it's a fake, but the images looked good. The seller is of low rating, but because I'm an awkward sod and knowing I've some protection from paypal, I thought what the hell. If somebody has made a mistake, then I will see what happens. So I bought the item. Committed to pay immediately to complete the transaction, I paid my hard earned £100 via paypal instantly. "Dear spunga, You do realize this watch is for £8,000 not £100? And i also said that i don't accept Paypal? I know it was as buy it now for £100 but i only did this because i am a new seller eBay won't let me sell anything for more than £3,500 and i just need to sell this watch so i had no choice, sorry about that but i'm not selling it for £100. Thanks, Debbie - sales.auditor.100" What would you do next?????? |

To me she didn't make a mistake... She was deliberately trying to circumvent the rules.
I'd despute it with eBay and take her to the small claims court if necessary. I wouldn't get screwed up about it but I'd try everything within reason to hold her to the legally binding contract she willingly entered into!

She stated in her ad what the sales price was and that she didn't accept PayPal. The buy it now would not be in itself a binding contract so no, she doesn't have to honor it but I probably would report her to EBay as this is a violation of their rules. She could have posted the watch for sale on a regular forum such as TRF which does to have such restrictions.

I don't know much about paypal, I guess you are able to get your 100 back...But I wonder if dozens of people sent 100 each, and she was able to keep it, she could make some easy money.

you'd be wasting your time trying to force her to ship you the daytona, even if she did how will you feel about yourself? i wouldnt feel comfortable accepting such a deal ... just move on and do it the right way

I would quit trying to be the sort of person who expects something for nothing, that's what I'd do. You can try to pull off your "gotcha" and see if you can enforce the contract. If you do, though, you become the reason why we all hate a litigious society.

I think if you do anything your only going to end up with time wasted and no watch as an end result. Your choice but I'd forget about it and just get my £100 back.

I saw this last night and could see that it was an off-Ebay solicitation.
You'll get your £100 back no problem. Ebay should just "off" the seller.

Personally, I would never try to enforce a contract where I knew or had reason to know that it was an obvious error on the part of the seller or buyer.

While I agree that you should just get your money back from paypal, I fail to see why some think it was an error on the sellerspart. Her email made it clear that she listed it for that sum in violation of ebays rules to entice a buyer at her price off ebay. Report it to ebay.

I committed to buy this second item to remove it from the market.
I've spoken to eBay who have cancelled both transactions and will be investigating the seller. They suspect it's not a scam at this stage, just a circumvention of fees breach plus some other ignorant breaches of their terms. She, the seller has emailed me, the funny thing is she replied to my question asking if she truly is an Auditor, and the reply was yes. LOL. |

I was interested to see where it led me more than anything.
I don't want a job being a policeman but sometimes I do think some people need to taken-to-task and be accountable for their stupidity and/or avoidance of their obligation. No is the answer. |
