Rolex sent to RSC for service, got confiscated

My cousin purchased a brand new Datejust 16200 from an AD in Northern California in 2006, and recently sent it over to RSC for its first overhaul. However, the service rep is refusing to return the watch to her on the ground that it is a stolen piece. They claim that the F serial is registered to another individual and "came up red in the system".

How could this have occurred?

We tried contacting the AD, but they are no longer in business. Could the AD have recorded the sale under another person's name, and sent it over to Rolex with the intention to reclaim the watch in the future? Is this even remotely possible???

Any idea on where to proceed from here? Thanks in advance.

Was it pre owned..? No receipt or record of the transaction??

Find the purchase receipt or a credit card statement, etc., and consult an attorney.

Yup, your going to need proof of purchase. I would guess the receipt is long gone and since the AD is now closed the only options would be:

Credit Card Statement-I am sure they can provide
Cancelled Check-Bank can provide
Warranty Papers-is her name on them?

I had a receipt from my 32 year old Submariner-Date. I tossed it a few years ago. I sold the watch in 1989.

How did this surface up?
Did the service rep call and tell your cousin?
Or did your cousin call up RSC?
Or did RSC send a letter to your cousin saying so?
Sure like to see the contents of the letter or how RSC worded it.

The receipt may have gone, but you would still have the warranty card with your cousin's name on it? Most people, esp with a modern Rolex, would keep everything that came with it, box, warranty, manual etc ....

Purchased a rolex from a trusted seller on this forum, took it the following week to the RSC in LA for the $150 insurance certification. The following Saturday I returned from a business trip and opened a letter from the general counsil representing rolex saying my watch was reported stolen in 2006, dual ownership, they are keeping the watch until the matter is resolved. I contacted the trusted seller who sold me the watch on Sunday & Monday morning, the next day, this trusted seller wired a complete refund into my bank account. Needless to say I will support this TRF seller! I feel your pain, good luck.

If the watch was reported stolen I'm not sure having receipts would show anything other than the OP bought the watch. That's not in doubt. I bet this won't be easily resolved, a dual ownership as posted above it seems.

Seems to me that Rolex USA would at least need a police report to flag the watch in it's database.

Yes, normally you've got to provide a police case number when you report a watch stolen to Rolex.

Just out of interest is it possible to ask Rolex about a serial number before you buy a watch ? To make sure it's not stolen. I was all for buying non AD but this has freaked me out a bit. Two threads about confiscated watches tonight.

OP, that's awful.

In the past, some discussions have took place here on TRF, where people said a watch purchased in "good faith" may be returned to you. The original owner may have already been compensated through insurance, etc....

You need to find a receipt if at all possible !!!

It's a very slippery slope and I would love to see exactly what happens.

For the guy that got the refund from the TRF seller, yes, they are the best

Rolex will not reveal serial numbers or verify status.

How do we go about purchasing pre-owned watches from TRF members here or even grey dealers then if it's been warrantied under the original owners name?

My understanding is if you own the warranty card regardless of the name on it, Rolex considers you the owner of the watch.

Agreed, I posted a thread on here a few days ago about "Name on Sales card" The general information I received in this thread was that Original buyer's info stays with AD. Rolex is only notified once it goes in for service.

As long as you have the original papers or RSC service papers, no worries. Buying from reputable TRFers is key. Most of us will make it right if this were to happen.

My god! I'd have my lawyer on this so fast if it were me. I guarantee my lawyer would want to see proof that this watch is stolen ie. police report, insurance claim etc. don't let them walk all over you man, demand documentation. Good luck getting this handled.

Sorry you re having that kind of problem. I personally wish Rolex would make the stolen database available to the public so crimes like this would be less likely to occur.

Sadly, I think you may be right. Unless you are the original owner and bought it from an AD there is always a small chance this could happen.
