Quazi Fake DSSD on eBay
How can they sell this on eBay when it's obviously a fake of the DSSD? All the buyer needs to do to make a fake out of this is buy a Rolex DSSD dial.

That's just it, he doesn't say "Rolex" in any part of the description nor is there any Rolex branding on the watch.. I would imagine it doesn't violate the rules.. Pretty crappy but what can you do..

He has 90+ items on ebay that are like a do it yourself fake a watch store. I'm not sure it is illegal to sell these generic parts. But if you start throwing around trademarked names like this one, GMT Master II http://www.ebay.com/itm/GMT-MASTER-I...item4abbb9d9d4
It must be a ebay violation right? I reported it. Lets see if it gets taken down. |

This is where the world of patents comes up. In many cases, design elements and even the "look" of a piece, the shapes of corners, etc., are patented as they define the brand, and nobody but Rolex is authorized to duplicate certain patented parts. The clasp looks like a patent infringement if you ask me, and even without the words, it's obvious that the "Ring-Lock System" is being imitated. Even if it doesn't actually operate internally with the same functionality, at some point down a checklist you're going to be checking off so many likenesses that you'll hit 95%, and at some point you're going to have to treat it as a fake even without the brand name on the dial. I think it's past that point myself, but I'm not a patent attorney.

As long as the word Rolex doesn`t appear on it nobody`s going to bother calling a lawyer,it`s not worth the bother for an item with such limited appeal.

I guess I could see it either way: Rolex ignoring it or going after it. Sometimes the big companies are extremely fastidious about any kind of infringement, and for good reason. I had thought Rolex was one of those companies proactive in guarding their intellectual property wherever it is infringed upon, but you may be right that they would see it as not worth their time. I just don't know.

He has what are used to make fakes, but he does not mention Rolex, however I do not agree with his business ethic, he sells exact design copies and calls it a deepsea. I don't think we can do anything, but surely Rolex has a patent on the name deepsea and design.

Bear in mind that these cases etc are about 2% cost of a real Rolex so it will not affect rolexc and you would be hard pushed to prove it
Cheers
