The auction itself is legal because airports legally sell all unclaimed property in Lost & Found via auctions. I agree the buyer needs to worry that it could later be reported as stolen - but if the Rolex is authentic and the seller has an airport auction receipt, then no grounds for eBay to pull the auction.
