My wife is having a T-shirt made
Good morning people. My wife is trying to have me a T-shirt made in reference to my new LV. It will read "I'm with my LV Sub with an arrow pointing to my left wrist. It will also have the Rolex crown on it. I know sounds a bit rediculous. (Personally I think she is trying to get me knocked off for it haha) Anyways my question is, if the Rolex crown gets put on there is that in anyway copyright infringement?

Why would copyright infringement matter? Surely she wouldn't intend for you to wear it outside the house?

Only if you sell it for a profit or berate the trademark. My brother just got 'caught" making racing shirts for friends because he gets jerseys cheap and is a big fan. The race group went after him but when they found out there was no $ and it was in the spirit of being a fan, they backed way off. YMMV.

I would wear the shirt in a social situation among friends such as a BBQ or a Rolex Fan get together.. but
I do not think it would be a good idea to wear a shirt that could draw unwanted attention to your Rolex in public. Unless you are Chuck Liddell or Quinton "Rampage" Jackson Sean

AFAIK, there is only a trademark violation if you are using it for commercial purposes. Don't try to sell it. IMO, it's no more a violation than Jocke's tattoo. Heck, they should pay you for free advertising!

As others have said, it's Trademark, not copyright, infringement.
And if I recall (I'm a patent guy, not much TM knowledge), it doesn't matter about commercial sales for you to infringe. If a company allows use of their trademarks without enforcing them, they could eventually lose their rights to them by having them ruled abandoned and in the public domain. I recall this when reading about Disney going after schools and daycare centers for unauthorized murals of their characters. Professional sports leagues do this too to local youth programs. Again, not up on the particulars of enforcement and all. Maybe Ed (Rockrolex) would know. He's one them evil IP attorneys. |

I do notice that whenever you see their logo online or on any of thier products there is not "R" next to it. Don't know if this means anything or not.

My wife makes my Rolex shirts and caps. I use them for personnel use. Nothing illegal there. There are Rolex logos used in this forum, nothing illegal there.

Hello all,
I am new to the forum (been lurking for a while) and thought that I would say hello and add a comment because I am a trademark attorney. Scooby is 100% correct. The use of someone’s trademark (T-shirts, hats, this forum, etc.) is technically infringement. While I doubt Rolex will chase the average consumer down, they do have the legal right to. FYI the R in the circle means the mark is registered with the Patent & Trademark Office. Thank you for allowing me to jump in. |

Rolex are very protective of their brand and go after trademark infrigement. Not only are the conponents of image trademarked but likely also the placements, e.g., the minimum distance between the princess crown and the word Rolex.
