My Daytona 116500LN Purchase agreement Contract

I've said on a couple of threads now that I signed a pre purchase contract for my daytona. Well here it is. I've blacked out the AD and the watch managers name.

I had no issue signing it and was happy for them to keep the warranty card.

It took me three years to get it.... To be honest I think it was luck on my part I'm not really sure I was ever on any list even though I had been pestering them for one.Take from that what you will. I'm not even close to being a VIP purchaser with this dealer however I do have service and purchase history with them.

I say good for them to try and make sure they are selling to someone that wants the watch, not someone that wants to make 6k. They are fighting for the WIS. I would've signed no problem

if it helps people actually get the watch at retail, then great. Something has to be done... as for the outrage comments which will follow. This will be fun

Funny that it says that you have to sell it back to them, but doesn't mention at what cost.

ridiculous as it sounds, I have no problem to sign this kind of contract if I can get the watch in the timeframe I want

Likely below purchase price. The AD is allowed to profit, but not you.

I have no problem with those terms. If a person wants a watch badly enough to wait for years, then presumably he/she would have no issue with the AD holding the card for a year, etc.

If this gets more Daytonas onto the wrists of watch lovers then well done.

Sorry but is this agreement enforceable? Is the penalty that the OP is barred from future business with said AD if the OP violates the agreement?

It awesome OP got his watch but the one year hold on the warranty cards seems heavy-handed enough, much less signing an agreement. C’est la vie...

interesting..... i'm kind of on the fence with this one...

I agree something needs to be done with flippers and grey mkt.... but if i just paid $12,400 for a watch you'd think i'd have free reign to do whatever i want with it

I have no problem with this. I don't buy watches with the specific purpose to make money or resell. I want the actual watch, not the profit. I'm beginning to seriously doubt some others though as to how much they want the watch vs the profit or hype...

So funny ! I mean I’m not lawyer , but no way any of this is enforceable other than the AD being able to hold the warranty card. I think even that is suspect if challenged in a court of law. But kudos to the AD for trying to do something, no matter how silly, to curb the flipper/gray problem

Well I guess it's nice to see that they are trying to sell it to someone who wants the watch and is looking to keep it and not resell. But the terms in there are absolutely ridiculous. 3 years, my a$$! Who are they to dictate what you do with your personal property? What if you wanted something else? Or experienced an unexpected financial hardship and needed the funds?

In the end, there's nothing they can do to really enforce this anyway. They should take out some of the harsh language and make it more of a memo of understanding that basically your relationship is over if they find out you broke the terms of the agreement, thus not getting any other sought after watches from them again.

I have no idea if it’s enforceable as I’ve no intention of testing it. It took me three years almost to get it so I’m not giving it up now.

People dislike car analogies, but think about the Ford GT. Ford retains a contract (even sued John Cena) that states you can not sell the car over certain time and other terms of the contract. If a Manufacture or even dealer wants to choose, which clients receive a limited production item (in this case Daytona 116500), why is that necessarily so bad. Unless someone plans to flip

Even worse. You may have it be decided in the court of Rolex

What if the AD sends your name to HQ or other ADs in your region and then, you are on a new Rolex "black list". Not they have that, but I'm not chancing it. I want my Daytonas, GMT Masters, and Subs
