Local man busted with FAKES

I'm not sure if this worked or not but this article is about a guy in Oregon who brought in 8 fake rolex's and the confiscated them. Homeland security sent him a bill for $53,000 fine which is supposed to be the value of the real watches.

Notice the breaking new in the link!

Odd to see the US enforcing trademarks. I'd think it was entirely a civil matter.

I think it sounds a little unfair, too, especially since from what it sounds like they were pretty cheap and he just bought them as gag gifts. However, I think the real reason he is being fined so much is that the government tried to contact him, and couldn't get ahold of him for months. They HATE that!

So while it seems unfair, there are always 2 sides to every story.

I am a U.S. Customhouse broker. Customs does indeed enforce trademarks which are on file with them. Under Title 19 133.27 CBP may impose a civil fine under 19 U.S.C. 1526(f) in addition to other penalties. First violation is not more than than value or original merchandise. Second violation will not be more than twice value of original merchandise. It is very likely that amount will be mitigated down to a relatively low amount for this poor sod. One thing to keep in mind is that CBP (Customs and Border Protection) can go after "any" person who direct, assists financially or otherwise, or aids and abets the importation of merchandise for sale or public distribution that bears a counterfiet mark.

That's a crazy story... good thing Rolex isn't going after him as well... I guess it could be worse.
