recieved a fake

Merry christmas eveyone, hope eveybody is well!

Well i bidded on a datejust on ebay and won the auction. I've paid 3900USD through paypal and recieved the watch in a month's time. Little did I know that what i recieved was an actual replica

I've contact the seller and his reply was that in the auction he did not state that it was neither authentic nor a replica, therefore I cannot hold chargs against him.

I've filed a complaint (not as described) with paypal and i'm waiting to see how it goes. However, looking at the auction again, i'm seeing that the item i bidded on is covered up to $200 only!!! Does this mean that I cannot get my money back?

Morover, if paypal address this issue in my favour, how would they go about it? Force the seller to pay?, or does paypal take out from their money?

please I need feeback!!!

If you paid through Paypal with a credit card, call your issuer and dispute the charge. Then mail the fake back to the seller.

You may run into problems with Paypal, but it's better than being out $3900 for a fake.

Correct. If you paid with a cerdit card via paypal, call the credit card company right away!

Good point. There are a lot of people on here that report fakes and get the auctions deleted. At least we might be able to stop future rip offs.

IMHO many people don't have a accurate understanding of risk/reward ratio of dealing with ebay.

I purchased a counterfeit from a current major eBay seller.

Even having an AD look at an eBay purchase and/or opening the caseback isn't an accurate method of establishing authenticity.

People sometimes have an erroneous belief they purchased the real thing because they think they properly authenticated.

I also wish you the best outcome, Robertus.

PayPal may place you into collections if you dispute with your credit card directly and it somehow costs them funds.

You might want to research if that possible consequence exists.

The site paypalsucks hits on some reasons I avoid PP.

When something goes wrong with a auction purchase it's a nightmare.

You are much better off dealing with your CC company as Paypal is limited in how they can get your $$$ back. All the seller has to do is close his account and you are out the entire amount. Call your CC company right away and tell them you are victim of fraud and go from there... Good Luck!

There are good sellers on e-bay, but I have read where the fraud, counterfeit, or abusive marketers, as a whole, actually outnumber honest businessmen.

My experience doesn't validate this point of view as far as my overall history with Ebay but I have no experience with purchasing a higher end watch from Ebay. Many members have have had good results from Ebay but when purchasing any high dollar item you certainly have to do your research.

Please post the details regarding this purchase so we may all learn. Good luck!

I'm glad your experiences have been good...I think anybodies can be with due diligence....but we tend to dwell on watches here. e-bay has other issues as well, so buyer beware should always be the approach..

There are many members here who have had good experiences with Ebay purchasing Rolex and other watches from them. Many people I know have had similar experiences.

To say that "fraud, counterfeit, or abusive marketers, as a whole, actually outnumber honest businessmen." is alarmist and not correct in my opinion. Ebay, like any marketplace requires due diligence.

Sorry to hear that you've been conned. Damn sellers being vague about their descriptions!

I would deal with the CC directly. Paypal sucks 99% of the time, but then again there's a 1% that they can help out so don't count them out yet.

Report that seller as selling questionable items and leave a negative feedback!

I always invite my students to analyze a situation. While this is not a classroom setting, I ask, how reputable was this seller if he responded the above? Thank you guys for all your support. In fact I did contact my cc issuer because paypal has just been going into loops!

The seller appoligised and refunded almost all the money (-50$) after I threathened to sue him. He was not aware that the watch was authentic! Anyways i'm really reliefed and all turned out ok!

The auction was for a datejust btw. Crazy things going on the internet!

Dude, $50 is a cheap lesson. While I am sure you will have trouble considering e-bay again, there are a lot us who have purchased watches there with no problems. If you do go back, look for:
  1. Sellers who sell nothing but high end watches
  2. Have been on e-bay a long time
  3. Have 100% positive feedback
  4. and list their phone number so you can call with questions.

Better luck with your next purchase

So what was his eBay ID?????? And you got your money back in one day, that's pretty darn fast....

I am a merchant and buyer. I know that credit card company is always on the customer side, almost in all cases. American Express is top for being for the customer. But other credit cards are great. Put in a dispute of the tranaction with the credit card company, you will be credited immediately then investigation begans. As a merchant, it sucks sometime when you have a cheating customer not wanting to pay for the real stuff. But in your case, I am very sorry to hear that some Ebayers are thieves and out to get hard earn money from us. Keep all you paperwork with Paypal and Ebay for the dispute. You're O.K. - don't worry too much. They will give your money back for sure. Don't delay, call now. Best of luck. Make sure you use Credit Card for Paypal and not your bank account. That reminds me to change mine soon. ~Hien

Let me tell you something. If you had $3900 to purchase a Rolex you could have gone to a reputable Rolex website dealer with that kinda money. By filing a Paypal complaint, $3900 was taken out the sellers account automatically for at leat 30 days and if you call your creditor they will take another 30 days to investigate, so the seller and you do not have access to those funds. The credit card company investigations take longer than paypal. Its a 50/50 chance either you get your money back or not. You should have made a deal to let him keep $100 for the fake and refund you your $3800 to end the case quicker. Otherwise your looking at 45-60 days til both sides investigates and neither one communicates with each other.
