what it takes to be a good laywer.
Since I'm going through a very fighty divorce where my wife has already lost,my lawyer and I are wondering why she keeps on fighting and throwing money at her lawyer even after 5 years. The answer basically is she just want revenge of course,but honestly speaking her lawyer has a reputation of somebody who is just after the money,either his client money or the final " grand prize " money. The guy had already a couple of cars torched in the past..go figure. Basically he's brainwashing my ex wife into keep fighting becuse he had figured he won't be squeezing any money out of me.
So really, does it all end with " I'll become a lawyer just for the money " ? I like to think that one becomes a lawyer for the love of law and justice first,then money enventually will follow. I mean,when does a lawyers lose his very little,if any, touch of being "human" just to get his paycheck rather than having his client get out of trouble ? Sad.. |

My own experience has just been for house conveyancing and it seemed good value to me at the time, a far better experience than buying used cars.

"Lawyers" covers a whole bunch of ground. I'm sure you're very frustrated, as divorces often are very very emotional (obviously). But like watches, there are good lawyers and bad ones. No waiting list for either.

Well,not really anymore,the thing has been going on for 6 years now,I have since then found the love of my life and we have a beautiful and healthy 3 years old baby boy that keeps our lives busy and happy,I've just posted this just out of curiosity. For example my lawyer proved to be a very human person sometimes,he did not want to go into this case since they were no kids or properties involved,but in the end we were forced to fight back. I call that honesty and integrity maybe ?

Andy, it’s ironic I was having a conversation yesterday about how our 3 business lawyers are not agresssive enough. Basically shooting down any issue we bring up, saying it will cost you a ton of legal fees and you may win, or you may not... I find it hard to pursue legal action when the lead is displaying wavering certainty around getting the job done.
So there are lawyers that don’t think money is everything, my three seem to care about my business, me and our relationship. |

Its just a job... most lawyers i know are just in it for the money...200-400 per billable hour. Ambulance chasers are the worst, ive dealt with my fair share.

Personally,if I was a lawyer, I would look after my clients so that my bills are paid off,that's the manin thing. But maybe I'm talking about smaller stuff point of view or something. The big picture lawyer sueing some big @ss corporation to squeez as many millions as possibile for his client and for himself that's another story.
Yeah,probably I wouldn't be a good lawyer... |

It takes the presentation of facts in front of the judge to become a good lawyer.
Many lawyers have egos that can easily turn them into tyrants, and abuse their standing as professionals. Try to settle your dispute through mediation. |

Always smart to generalize and extrapolate based on one anecdote. Because law is just like you see on tv, they go from big corporate deal, to trial to divorce, if you have met one lawyer you know them all.
Most lawyers never even go to court and aren’t litigators. |

I'm guessing because our law handed down from the British in most respects was an adversarial system which is based in antagonism. Two sides takes extreme positions and based on their arguments and the law, a judge or jury makes the final decision.
Probably an ok system but unfortunately it doesn't have much to do with what's right or what is truth. Like most things in life it's just a game played by the haves to deceive the have nots into thinking that everything is fair. |

Let's generalize. Think of a lawyer like a salesperson-- "white shoe" law firm partners have described it to me as such.
Some get paid a fixed amount per client. Some get paid a variable amount per client. Some get paid a combination of both. Those that get paid a fixed amount (say, a price to help close on your house purchase), want to give good, quick advice and get the job done. Minimize hours. Those that get paid a variable amount (say, ongoing corporate matters) want to consider ways to (a) expand the scope of work and/or (b) dig deeper into the project. Maximize hours. Those that get paid a combination of fixed and variable (say, a % of recovery/settlement + billable hours) are in a different spot. Sometimes, if the matter is leaning towards a resolution (say, you'll be awarded $1 million with high certainty) they will want resolve the matter quickly. Minimize hours. Sometimes, if the matter has no resolution in sight (and, thus, less likelihood for a high fixed % payout), they will want to extend the scope or depth of work. Maximize hours. I can imagine a divorce is volatile and can vacillate quickly. Some lawyers may weigh their interests accordingly (no judgement here, just an guess). This is an over-generalization, but something I keep in mind when dealing with any salesperson. A real estate agent is not necessarily interested in squeezing every single dime out of buyers when trying to sell your house. They want to get a competitive price and a stable buyer, and get the deal done. 3% commission on $1 million and 20 hours of work is better than 3% commission on $1.1 million and 30 hours of work. (again, judgment free zone) Disclosure: I'm not a lawyer. I work with lawyers a lot. I ask very pointed questions. A good, healthy, commercial relationship with great lawyers is wonderful. If at any point, you think your lawyer is not a direct extension of your own interests, cut bait. This goes with any salesperson/professional (doctors too!). |

I was a patent/trademark lawyer for 44 years before I retired. In my firm (which we built from 3 lawyers to 140+ today), our motto was "practice good law and the money would follow." That was the truth. At one point, I was making over $1MM/year.
