US Custom

Hi.
I received a gift while visiting Hong Kong - Sub Date with Box and card etc… since this is a gift do I need to file any paperwork or report the watch to custom when I am returning to the US?

Whether gift or purchase is what it states on the declarations form.

Makes sense. Everyone would just put gift, otherwise, and would be truthful. What’s a better gift to yourself, than a brand new Rolex?

It does not matter how you obtain a product, if you are importing it into another country you need to declare it.

Why would it matter that it was a purchase, gift or winnings?

There seems to be plenty of folks who advocate that you break Federal Laws, but the penalties can be quite harsh when caught.

Declare it, if you get caught not declaring it you will go through enhanced screening every time you come into the us afterwards.

You will also get the watch confiscated, and be issued a fine in the value of the watch on top of it. Dumbest shit to do over $500 which is about what your tax will be if they even bother.

When you declare it, they will ask for the receipt. This is what they will use to determine the customs duty.

If it's a gift let's assume you do not have a receipt or proof of purchase.
Otherwise they will TRY to calculate the amount.

Things may become not so pleasant.

Quite correct. A friend wore some undeclared jewelry up her arm and was caught in US Customs. Jewelry confiscated and she is still pulled off for special screening 15 years later.

I travel to over 40 countries each year. I declare any purchases religiously but nearly all the time the officer just looks over my declaration and says “welcome home”.

There is no deviation form in USA at least in last couple of years. I have Global Entry but haven’t seen any declaration form distributed in a long time.
For global entry is a machine takes your picture and lets you proceed to officer, they have asked me and I tell them the amount and recently over 2$k and they ask what’s irene, and then let me go through easily.

I always put all my receipts in an envelope, convert amounts to US$ andcwritebinbricjet minus any VAT refund , then create a list of each item and the value and add the amounts up. I keep it handy in my carry on and on my iphone notes the list.

In case I can demonstrate.

Books btw don’t pay taxes. but i still declare those on my traveling list .

Souvenirs and small gifts I tally as a total.
The tax is not much after 1,000$, usually they let you through and no charge. but declaring say $20,000 different story.

I don’t want any issue for not declaring. Best to be organized and declare.

I do the same. Just got back from Asia yesterday. No declaration form to be filled out. Global entry and not a single question even asked and that's with 5 large pieces of luggage.

If you are bringing an item into a country, you did not already own in that country, you need to declare its value when you arrive and pay whatever money is due.

The more the omission appears intentional, the worst it can get quickly.
